Food Safety Notice & Assumption‑of‑Risk Acknowledgment
Last updated: [LAST UPDATED] · Effective: [EFFECTIVE DATE]
Draft — not legal advice. Review with a licensed attorney before use. Liability waivers for food/personal injury are limited or unenforceable in many jurisdictions and cannot waive liability for gross negligence, willful misconduct, or rights consumers cannot waive. Treat this as a disclosure and acknowledgment, not a blanket release, and have counsel tailor it to the laws where you operate.
This notice applies to food obtained through [PLATFORM NAME]. By ordering, reserving, or accepting food, you acknowledge and agree to the following.
1. Food is prepared by independent Vendors
Dishes are prepared by independent cooks, teams, and companies — including food made in home and cottage‑food kitchens — not by [PLATFORM NAME]. [PLATFORM NAME] does not cook, inspect, handle, or deliver the food and does not guarantee its safety, quality, or accuracy. Preparation environments may differ from commercial restaurants and may be subject to cottage‑food laws.
2. Allergens and dietary needs
Food may contain or have been prepared in facilities that also handle common allergens (for example, milk, eggs, fish, shellfish, tree nuts, peanuts, wheat, soy, and sesame) and other ingredients. Cross‑contact is possible. Ingredient and allergen information comes from Vendors and may be incomplete or inaccurate.
If you have a food allergy, intolerance, medical condition, or dietary/religious restriction, you are responsible for confirming suitability with the Vendor before ordering, and you assume the risk of consuming the food. Do not rely solely on listing text. If you experience a medical emergency, seek immediate medical help.
3. Safe handling of perishable food
Perishable food must be handled safely. You are responsible for receiving food promptly and for refrigerating, reheating, storing, and consuming it according to safe food‑handling practices and any instructions provided. Food left at unsafe temperatures or consumed after its safe period may be unsafe.
4. Assumption of risk
You understand that preparing and consuming food carries inherent risks, including the risk of allergic reaction, foodborne illness, or injury. To the fullest extent permitted by law, you assume these risks and agree that [COMPANY LEGAL NAME] is not liable for harm arising from food prepared by Vendors, except to the extent such limitation is not permitted by law (for example, for gross negligence, willful misconduct, or non‑waivable statutory rights). Nothing in this notice limits a Vendor's own responsibility for the food they prepare.
5. Reporting problems
If you receive food that appears unsafe, spoiled, mishandled, or grossly misdescribed, do not consume it, and report it promptly through the in‑app tools or [support@…] with details and, where possible, photos. See the Refund & Cancellation Policy.
6. Relationship to other terms
This notice is part of and subject to the Terms of Service, including its disclaimers and limitation of liability, and does not expand your rights beyond what those documents and applicable law provide.
